The administrative responsibility for public services was admitted to guarantee to users thereof the right to compensation for damages resulting from their activities.
Among its services, it is retained in the public hospital.
Initially, the responsibility of the latter arises only for misconduct.
However, several reason , including that related to technological progress , have need for another faceoff basis of liability of such an establishment , namely that of no-fault liability for the use of healing techniques dangerous and free methods known in the treatment in psychiatric hospitals.

La responsabilité administrative des services publics a été admise en vue de garantir aux usagers le droit à la réparation des dommages résultant de leurs activités.
Parmi ces services, on retient celui de l’hôpital public.
Initialement, la responsabilité de ce dernier n’est engagée que pour faute.
Cependant, plusieurs raisons, notamment celle liée au progrès technologique, ont nécessité de recourir à un autre fondement de mise en jeu de la responsabilité d’un tel établissement, à savoir celui de la responsabilité sans faute du fait de l’utilisation de techniques curatives dangereuses et de méthodes libres connues dans le traitement au sein des hôpitaux psychiatriques.
