Abstract EN

The french legislatur has determined the legislative frame work for transfor of discretionary power through many of the most important legislation of the law especially the law of march 1982 concerning to rights and free dons of territorial regional units which is consider as the Neal start of the transfer of discretionary powers because it determined the general framework through redrawing the French territorial division, and then successively after proglumale a lot of legislations relatng to the transfer of discretionary powers between the state and regional unite and arose a lot of important applications which were varied according to the different political will of the rulers in the state.

All this was happening before the eyes of constitution and administrative judge, who were credited with inventing many of the organizing rules for the transfer discretionary power process in the context of decentralization.
