We wille delt with very important subject concern the history of Algeria wich is Islamic judiciary in colonial Algeria, and the French legislation issued thereon, as we know judiciary is the principe of fair life all societies without esception, islamic judiciary or islamic justice it was known as the French occupation time known many decisions and decrees which the majority of them were restricted the powers of the Algeria Muslim judge, thus the decline of the Algeria Islamic judicial departement in small space, what led to the breakdown of many sensitive subjects the powers of Muslim judge for example criminal issues.
