Abstract EN

In this research, we study the subject of the non-usable medicine, which has spread and widened to the point of showing its disadvantages and causing death and serious damage.

the aim of this study is to highlight the seriousness of this phenomenon facing patients by calling for treatment through monitoring and follow-up on the one hand and the application of the rules of civil liability associated with the chain of production and distribution on the other hand.

in order to reveal part of the civil responsibility raised on the production and circulation of medicine and in order to raising citizens' awareness of their rights, which leads us to raise the problem of identifying persons responsible for non-usable medicine if it’s are limited to the pharmacist or distributor or extend to the producer? what is the basis for civil responsibility?
