This research is a jurisprudential study to demonstrate the legitimate verdicts of medical errors related mainly to the profession of medicine which relates not only to the protection of one of the major destinations of the Islamic legitimacy (legislation), the soul protection,but also to the protection of the other entireties; the religion, the mind, the offspring and the wealth.
The study also supplies advice and guidance to help the patient be aware of the legal rights, and traces limits to not be exceeded by the doctor when exercising the job.
The current study includes intellectual, educational and social sides, taking the descriptive, inductive and analytical approaches as the main methods of research.
It aims at defining, analysing and criticising a set of concepts related to medical errors, their verdicts and consequences.
The researcher’s main references in this study are the Holy Quran and the Sunnah of the prophet (PBUH) which are the pillars of the Islamic legislation, besides to the consensus of scholars of Islam and opinions of jurists who have undertaken this topic.
