The present juridical study , dealing with the theory of contact is mainly characterized by the principle of will autonomy, this theory knew a historical advancement qualified by the principle itself influenced by the individual trend which allowed the strong part of the contract to master the weak part.

all this led modern laws, enriched with the collective vision of the contract , the restrict the above principle through regulations and rules linked to the content of the contract and its form and to give the judge the authority to control and intervene in the contract to achieve what we commonly call the collective and individual theory of the contra.
