Abstract EN

The study aimed to define the computer software program and how it is considered a literary and artistic works in accordance with the Law "Protecting Copyright and Related Rights of Sudan".

It also aimed to clarify the conditions that must be met in order to be entitled to the protection of the law, to clarify the rights to which it is entitled.

The study used the comparative descriptive analytical approach and concluded with a number of conclusions and recommendations.

One of the most important findings of the study is that the certificate of registration of the computer program is considered as a presumption that the owner is the author of the program, and that submitting a copy of the program to the Copyright and Literary Works Council is not a condition for protecting the program.

One of the most important recommendations of the study is to amend the definition of "Collective Work in the Copyright Law for the year 2013" by adding the word "corporate body " to the word "person" in the definition and encouraging the authors of computer programs to register and deposit their programs so as to preserve their moral rights and facilitate their verification in the event of a subsequent dispute over programs.
