Arabic Abstract
يهدف هذا البحث إلى الوقوف على قاعدة ( إذا ضاق الأمر اتسع ) و تطبيقاتها الفقهية الطيارة و العبادات أنموذجا بهدف المساهمة في نوعية المجتمع من خلال فقه رفع الصيق و الحرج و المشقة عن المسلمين.
و قد تم تقسيم الدراسة إلى فصلين تناول الفصل الأول : حقيقة إذا ضاق الأمر اتسع من حيث بيان معناها، و أدلة مشروعنها، و أهميتها.
و تناول الفصل الثاني التطبيقات الفقهية لقاعدة إذا ضاق الأمر تسع في العبادات و تم دراسة الأحكام الفقهية دراسة مقارنة بدءا بالطهارة و انتهاء بمسائل الحج.
و قد خلصت هذه الدراسة إلى : 1- أن معنى القاعدة هو الترخيص للمسلم إذا ظهرت مشقه في أمر ما، فإذا زالت المشقة عـــاد الأمر إلى ما كان علية.
2- ظهور مدى يسر الإسلام و مراعاته لأحوال المكلفين و قدراتهم من خلال تلك التطبيقات.
English Abstract
The purpose of this research is to identify : the rule ( if it was narrow it would expand ) and its jurisprudential applications in purity and worship as model to contribute to the awareness of society through the jurisprudence of raising distress and embarrassment and hardship for Muslims.
The study has been divided into two chapters : The first chapter deals with the fact ( if it was narrow it would expand ) in terms of its meaning, its legitimacy and its importance.
The second chapter deals with the jurisprudential applications of the rule “if the matter was narrowed it would expand” in worship practices.
The jurisprudential rulings were studied through a comparative perspective, beginning with purity and ending with the issues of Al-Hajj The study reached the conclusion that : 1- The meaning of the rule is to permit the Muslim if trouble appeared in something, if the hardship is removed then situation returns to what it was before.
2- The appearance of the extent to which Islam and its observance of theconditions of the believers when performing their duties and their abilities through these applications.
