Arabic Abstract

قدمت هذه الرسالة بعون الله و توفيقه لإبراز شخصية أبي جعفر الطحاوي عالما من علماء الأمة الإسلامية، و لإبراز قوته في استنباط الأحكام الشرعية من أدلتها التفصيلية، و كذلك لبيان طريقته في فهم النصوص، و لإبراز درجته الفقهية التي تبوأها بين الفقهاء و هي إحدى الأهداف من كتابة هذه الرسالة، و لقد كان رحمه الله أحد الأعلام الذي استطاع أن يجمع بين العلمين الشريفين و هما علم الحديث و علم الفقه، كما قال الذهبي و أبدع و أتقن بالتأليف و التصنيف فيهما، و التركيز في هذه الرسالة كذلك على بيان منهجه في الاستدلال تم مناقشاته للأدلة، و ترجيحه للقول الذي تؤيده الأدلة حسب فهمه و نظره إليها، ثم تصريحه بالمخالفة أو الموافقة الشيخه أبي حنيفة رحمهما الله تعالى، و معروف أن إيرار الشخصية الفقهية الاجتهادية لا نظير إلا من خلال عرض مخالفاته المدعمة بالأدلة، و لهذا السبب ذكرت بعض المسائل التي خالف الطحاوي فيها شيخه أبا حنيفة مع الأدلة و المناقشات و الترجيح، و بينت خلال دراستي أن لأبي جعفر الطحاوي تأثيرا فقهيا قويا على المذهب الحنفي خاصة و على الفقه الإسلامي عامة.

English Abstract

This thesis was presented with the help of God to clear the character of Abu Jaafar Al-Tahawi, a scholar of the Islamic Nation, and to highlight his power in deriving the Shariah rulings from the detailed evidence, as well as to clear his method of understanding the texts, as well as to clear the degree of jurisprudence that is adopted between the degrees of scholars, which is one of the goals of writing this letter, and to represent him as one of the major scholars, may god have mercy on him.

With his creativeness and precision, he classificated his works.

The focus of this letter as well as the statement is about his approach in the reasoning and then the discussion of the evidence, is to support his evidence by approved evidence according to understanding and study, then his statement about agreeing or disagreeing on certain evidence of Sheikh Abu Hanifa "God's mercy on them", Only through the presentation of the remnants of the scholar, and that is why I mentioned some issues that Al-Tahawi disagreed with the Sheikh Abu Hanifa with evidence and discussions and weighting, and showed during my studies that Abu Jaafar Al-Tahawi had strong philosophical impact on the Hanafi doctrine, and on Islamic jurisprudence in general.
