قتل الغلط و عقوبته في الفقه الإسلامي : دراسة مقارنة

Abstract EN

This research, entitled “ Error - Killing and its Punishment”, includes the meaning of felony, and killing and error - killing, and the punishment that the legislator delimits (determines identifies) for this type of killing, the difference between it and the other types of killing as stated in the books of the former (previous) jurists from the jurist of the four creed ( doctrines).

The researchers came to the conclusion that error – killing differs from killing by mistake, and its consequent punishment is depending on the type of error – killing.

The positive law considers error – killing as killing on purpose ( intentional killing) and makes its punishment accordingly.
