Arabic Abstract

يمكن القول إن تداول السلطة من أهم عناصر و ركائز الحكم الديمقراطي المبني على الإرادة الشعبية لعموم أبناء المجتمع.

و تواجه هذه العملية العديد من المشاكل و العقبات بسبب خرق القواعد القانونية المنظمة لهذه العملية و آلياتها، فأنظمة بعض دول العالم الثالث لا زالت عاجزة عن إدراك المعنى الصحيح للسلطة في كونها سلطة الدولة و ليست سلطة الحكام و انه لا يمكن احتكارها من قبل قوة اجتماعية أو سياسية واحدة و حيث إن من مهام الدولة الحديثة تحقيق مصالح المجتمع بكل قوة، فلا بد أن تتمتع جميع هذه القوى بحق تولي السلطة أو المشاركة فيها، و من ثم التأثير في صنع القرارات السياسية المعبرة عن المصالح العامة، و لما كان من غير الممكن ان تتولى جميع هذه القوى السياسية السلطة في نفس الوقت فانه لابد أن يكون هناك اتفاق معني بالكيفية التي يتم بها تداول السلطة سلميا بين هذه القوى و الالتزام به، فعندما تحتكر السلطة من قبل مجموعة معينة أو تشكيل معين اجتماعي أو سياسي واحد في الوقت الذي تجد فيه تشكيلات أخرى نفسها مجردة من حق تولي السلطة أو المشاركة فيها يصبح العنف وسيلة الذين هم خارج السلطة من أجل الاستيلاء عليها و أداة الذين هم في السلطة لضمان البقاء في الحكم وبالنتيجة تتناقص كفاءة النظام السياسي في الاستجابة لجميع القوى الاجتماعية وإحداث التوازن بين هذه المطالب، و من ثم يتضح أن التداول السلمي للسلطة يكاد يلخص سمات النظام الديمقراطي على النمط الغربي، حيث يستلزم حدوثه وجود تعدد حزبي وتنافس سياسي حقيقي وانتخابات دورية حرة ونزيهة ورأي عام قوي وقادر على التأثير ووسائل إعلام تقوم بدور رقابي فاعل في محاسبة القائمين على السلطة إن الديمقراطية هي مفهوم إنساني سابق على قيام الدولة الحديثة لذلك فان أي مجتمع يستطيع الأخذ بها وفق أسس تتلأم و مرحلة التطور التي يعيشها وهذا يعني إن التخلف أو التأخر ليس مبررا كافيا لعدم تطبيقها بآليتها (ومنها التداول السلمي للسلطة)، و من ثم احتكار السلطة السياسية تحت ذريعة تحقيق التطور الاجتماعي و الاقتصادي والسياسي، فالديمقراطية هي ممارسة عملية يحكم بها الشعب أيا كانت درجة تطوره عبر سلطة سياسية يختارها هو و يقر لها تنظيم شؤونه عندها تكون أي صيغة للحكم ناجحة إذا ما تم إقرارها من أغلبية الشعب.

و قد قسمت الدراسة على فصلين تناول الفصل الأول الإطار النظري للتداول السلمي للسلطة الدولة الديمقراطية، و تناول الفصل الثاني التطبيق العملي للتداول السلمي للسلطة في الدولة الديمقراطية.

و اقضت الدراسة إلى جملة من النتائج.

و منها ان التداول السلمي للسلطة يقوم على الرجوع إلى الشعب في تحديد اختياره فلابد ان تكون وسيلة الرجوع معبرا عن رأي المواطن و محددة لاختياره بشكل حقيقي و بذلك يصبح مفهوم التداول السلمي للسلطة رمزا بارزا لمفهوم النظم الديمقراطية.

و يعبر عنه من خلال النظم الدستورية و القانونية و محدداتها.

و من ذلك يصبح هذا النظام قائم اساسا على الفكر و الفهم القانوني الذي بموجبه تبنى وتقوض السلطة.

وتبقى القوانين هي الممثلة الحقيقة للسلطة.

و ان سلطة القانون تبقى هي الأسمى ولا سلطان يعلو القانون.

English Abstract

It can be said that the rotation of power is one of the most important elements and pillars of democratic governance based on the popular will of all the members of society.

This process faces many problems and obstacles due to violation of the legal rules governing this process and its mechanisms.

The regimes of some Third World countries are still unable to understand the correct meaning of power in the fact that it is the authority of the state and not the authority of rulers.

It cannot be monopolized by a single socio-political force, and since it is one of the tasks of the modern state to achieve the interests of society with all its forces, Participation in, and then influence the mouthpiece of the general interests of political decision-making Since it is not possible for all these political forces to take power at the same time, there must be an agreement on how to peacefully transfer power between these forces and commitment to it.

When power is monopolized by a certain group or a particular socio-political formation When other formations find themselves stripped of the right to take power or participate in it, violence becomes a means for those who are out of power to seize it and the tool of those who are in power to ensure survival in power.

As a result, an answer to all social forces and a balance between these demands Thus, it is clear that the peaceful transfer of power almost summarizes the features of the Western-style democratic system.

It requires a multiplicity of parties, real political competition, free and fair periodic elections, strong public opinion and influence, and a media that plays an effective supervisory role in holding accountable those in power.

Democracy is a former human concept on the establishment of the modern state.

Therefore, any society can adopt it on a basis appropriate to the stage of development it is living.

This means that backwardness or delay is not sufficient justification for not applying it by its mechanism (including the peaceful transfer of power), and thus monopolizing political power under the pretext of Achieving social, economic and political development Democracy is a practical exercise by which the people, regardless of their degree of development, are empowered by a political authority of their own choice and the organization of their affairs.

Any formula for governance will be successful if approved by the majority of the people.

The first chapter dealt with the theoretical framework for the peaceful transfer of power in the democratic state.

The second chapter dealt with the practical application of the peaceful transfer of power in the democratic state The study resulted in a number of results.

Including that the peaceful transfer of power is based on recourse to the people in determining their choice must be the means of reaction expressing the opinion of the citizen and specific to the choice of real.
