Work strike is a way followed by the workers since ancient times.

still, it is the most powerful weapon that workers and employees resort to in order to get their demands of their legitimate rights at work, either to improve working conditions, or to increase salaries in modern times, the evolution of the strike has taken other forms such as political strike, which prompted countries to find a way out of these strikes through the enactment of legislation and laws France was the first country that paid high concern to legislation and laws regarding the organization of the strike between criminality and permissibility; even the permissibility is constrained by terms.

then Egypt was among the first Arab countries that have resorted to legislation and laws to curb strikes, and continued to restrict the permissibility in public facilities, and prevent it in vital facilities meanwhile, Palestine knew strike long time ago.

one of such famous strikes is the strike of 1936 in which people could get some of the demands of the British mandate government.

staff strikes continued under the rule of the palestinian national authority, mostly for professional reasons.

the palestinian national authority negotiated and promised the staff representatives to meet their demands.

at the present time, since 2006, strikes has intensified, especially in Gaza strip as a result of non-payment of salaries; so that affected all public facilities including vital facilities, which had a bad impact on work field and the citizens however, the palestinian legislator gives no sign towards regulating the exercise of the right to strike, and this was the main reason to choose the thesis topic entitled: “the strike in public facilities in accordance with the palestinian legislation”.

the researcher compared the palestinian legislation to the French legislation and the Egyptian one overall findings and recommendations highlight most importantly : the need for paying considerable attention of the palestinian legislator towards the matter of strike, the need for organizing the strike practices in public and vital facilities to ensure the regularity of workflow, adding to the importance of paying high concern to the employee professionally and financially.
