Resulting from the application of the law 87/19 Which was replaced by the law 10/03 Specifying the terms and conditions of the exploitation of agricultural lands belonging to the State›s private property ,There have been many conflicts .Due to the exploitation of these agricultural lands by the private , It follows that these conflicts are subject to the Civil Code, on the one hand.

On the other hand, the ownership of agricultural land falls within the state›s private property.

Which means that disputes in this area are subject to the jurisdiction of the administrative judge, pursuant to the organic standard enshrined in the text of Article 800 of the Code of Civil and Administrative Procedure.

Which resulted in a swing of jurisdiction in the consideration of conflicts arising from agricultural lands owned by the State Between the administrative judge and the civil judiciary.

In this study, we exclude the agricultural real estate disputes before the criminal courts
