If the rights and freedoms in the legal state are based on the will of the constitutional legislator in the first place, which is a mirror of the popular will, the human conscience asserts that there are types of rights that do not require the approval of the legislator because they are natural, created by human nature, and are considered as main rights because the individual can not enjoy his life within a society without respect for these rights.
The most fundamental of these rights is the right of expression, as it is stated in the agreements and international conventions of human rights about the right of holding and expressing opinions freely.
The constitutions and internal legislation of other countries including Algeria have the freedom hold opinions and express them.
based on that these constitutions and legislation prohibit the infringement of freedom of opinion and expression, except in special cases and at specific times.
