Abstract EN

This study deals with the historical development of the concept of the authorized marriage officer )Al-Mathoun Al-Shar ’i( and the rules of his work in Islamic jurisprudence and the UAE law.

The importance of this study therefore lies in its tracing of the historical evolution of the judiciary and of the authorized marriage officer in Shari’a and the UAE law and the consequent conservation of rights and obligations when denial and disbelief occur.

The study concluded that the concept of the authorized marriage officer is essentially linked to the judiciary.

Formerly, the caliph or his deputy used to perform this task.

In the UAE, before the union, marriage used to be administered by al-Mutawa’.

But after the union, the by-law 619 of 2016 regarding authorized marriage officers was issued.

It made it mandatory for the competent authorities in the state to properly choose the authorized marriage officer to apply some of the rules that are prescribed by Shari’a and law.
