Abstract EN

A part of the Fiqh (jurisprudence) believes that collective labor relations are likely to play a more effective role in achieving social protection for workers.

This relationship has legal form and is governed by public order and the rules of Private Law, it is also under regulations and the provisions of Public Law (worker duties and rights), adding the attention of international and Arab organizations, and considering the tripartite meeting as a common principle in the constitution of the international labor organization ( ILO), which is confirmed by the Convention no 144 of 1976 related to the tripartite consultations to promote the application of international labor standards and the importance of tripartite consultations in the state and the state's role in creating appropriate conditions for both parts of producing and to urge them to take serious steps in dialogue as an effective way for solving some Labour disputes, and the emergence of the need to activate social dialogue.

In this context, this study is fullfilled in order to illustrate the importance of collective negociations as an effective means to secure the best terms and conditions of work and acquire more labor rights and benefits that exceed the minimum stipulated in the legislation
