Abstract EN

This research deals with the legal moral of companies in the Saudi legel system in comparison to Islamic law (sharia) and other legal systems.

The legal person is a hypothetical one who has the authority to acquire rights and to bear obligations.

The importance of this research lies in the fact that by determining the legal status of the company’s legal personality, many disputes that may arise in this aspect are resolved.

The research aims at explaining the concept of “legal personality”, its importance, beginning and end.

It also discusses the presenting provisions therein in the Saudi Companies Law and its incorporation..

The study finds many results, most important is that the legal person carries some responsibilities such as patrimony, the name of the company, legal capacity and nationality, in which the Saudi legislator contravened the other regulations, stipulating that the nationality of the company shall be determined by virtue of the reason in which it was established or by the place of its administration.

Among the recommendations of this research is the importance of studying the subject of legal personality and paying more attention to it.

The reason behind this is the importance of companies and their role in the improvement of nations and the revision of systems and laws with regard to determining the nationality of the company and putting specific and detailed provisions in the Saudi legal system
