Abstract EN

Settling disputes through judiciary between people has a great place and position, it is great work for its interests and benefits for the nation.

The judiciary is a way to achieve justice for the oppressed as well as establishing right among people.

It is the fortress to preserve the provisions of Sharia and its limits and the refuge which people resort to in order to settle grievances, so the scholars of jurisprudence exerted great efforts to clarify its provisions and to report it s principles as well as concluding its chapters through writing books and essays.

This Essay, which is the subject of study for Imam Ibn Nujaim is a model for that.

The Essay is innovated in its content, where the author devoted a question of the judiciary research which is a contradiction and discrepancy in the case the importance of this Essay is that If the discrepancy is found in the case, this shall be deemed to prevent the hearing of the lawsuit.

Imam Ibn Nujaim has divided his scientific Essay into jurisprudential chapters for easy reference when a legal case comes before the judge and he put some examples under every jurisprudential chapter as well as clarifying the judiciary ruling of them.
