The judicial jurisprudential rule which says that “The Oath is on the litigant who has the most powerful evidence” is the most important of the judicial rules in the stage of specifying the party that bears the burden of proof.It is a regular rule regarding the methods of proof relevant to judiciary.The jurists used this rule to proof the rulings, so It was necessary to study it in a fundamental and applied study that explains its vocabulary, documenting it, verifying its words, showing it legal root, and its relation to the rules of Shari'ah, its purposes as well as revealing its most important applications and branches.
