Abstract EN

Maintaining and concealing secrets of defending country are important duties on the shoulder of community.

They are important because these secrets can be considered significant state secrets which linked to the state existence and survival and on which the state security depends.

Some professions have many significant secrets exposed for any one in charge of a public service or any officer because of his daily job, otherwise it was impossible to see such secrets or know about them.

Noting that disclosing these secrets would damage the state interests and security, many states made legislations for criminalizing the disclosing of secrets of defending country within the texts of the Penal Low.

The study handled the relevant problems by identifying the objective framework of confidential information and documents, identifying persons committed not to disclose the secrets of defending country.

The criminal responsibility of disclosing such secrets helps maintaining the public good by supporting securities required to maintain such secrets.

If the officer or the person in charge of a public service is not honest or faithful, the public good will vulnerable to negligence and long-lost.

The most perplexing problems this study treated to find a solution is the differentiation between what secrets of defending country are ? And what are not ? In a time there is no categorization for these secrets.

The study is divided into three sections; section One presents the notion of disclosing the secrets of defending country and section Two is dedicated for the legal structure for the crime of disclosing the secrets of defending country and in section Three, the study introspects the punishment of the crime of disclosing the secrets of defending country .

And in the last is dedicated for the study results and suggestions
