Arabic Abstract

هدفت الدراسة إلى التعرف على طبيعة النظام البرلماني في ظل مسودة الدستور الليبي لسنة 2017، و التي أقرتها الهيئة التأسيسية لصياغة مشروع الدستور في 29 يوليو 2017 و التي صدر بشأنها قانون الاستفتاء رقم 6 لسنة 2018 من خلال دراسة مقارنة مع الدستور الأردني.

و تمحورت الدراسة حول بيان مدى كفاية الوسائل الرقابية التي نصت عليها مسودة الدستور الليبي لسنة 2017، و مدى توافر أسس و مبادئ و خصائص و سمات النظام البرلماني الحقيقي و الملائم في هذا النظام.

و لتحقيق أغراضها، فقد استخدمت الدراسة المنهج التحليلي و المدخل الوصفي المقارن.

و توصلت الدراسة إلى عدد من النتائج أهمها : أن بعض المواد في التنظيم الدستوري الليبي بحاجة الي المزيد من التوضيح والتحديد و خصوصا فيما يتعلق بتعريف طبيعة النظام السياسي الليبي، و حدود واختصاصات رئيس الدولة، و مظاهر الرقابة الادارية.

خلصت الدراسة إلى عدد من التوصيات منها : على المشرع الدستوري الليبي ان يكون واضحا في بعض المواد الخاصة بتحديد طبيعة النظام السياسي الليبي، و بما أنه لم يفعل ذلك فقد أنتج نظاما غريبا، فيكون النظام نيابيا في بعض الأحيان و رئاسيا في أحيان أخرى و مختلطا في ثالثة ولا نظام معروف في أحيان كثيرة، و كذلك عليه ان يعالج مواضع القصور في تحديد بعض اختصاصات رئيس الجمهورية, كصلاحياته في العفو العام و الية تعيين القائد الأعلى للجيش و المخابرات العامة.

English Abstract

Abstract the study aimed at identifying the nature of the parliamentary system under the draft of the Libyan Constitution of 2017 through a comparative study with the Jordanian Constitution.

The study focused on the adequacy of the means of control stipulated in the draft Libyan constitution for 2017 and the availability of the principles, principles, characteristics and characteristics of the real and appropriate parliamentary system in this system.

To achieve its purposes, the study used the analytical method and comparative descriptive approach.

The study reached a number of results : the most important of which is that some articles in the Libyan constitutional organization need further clarification and definition, especially with regard to the definition of the nature of the Libyan political system, the limits and terms of reference of the head of state and the manifestations of administrative control.

The study concluded with a number of recommendations, including : The Libyan constitutional legislator should be clear and clear in some articles on determining the nature of the Libyan political system.

Since he did not do so, he produced a strange system.

The system is sometimes parliamentary and sometimes presidential and mixed.

In a third and not known system often, and it must address the shortcomings in the definition of some of the functions of the President of the Republic, such as powers in the general amnesty and the appointment of the Supreme Commander of the Army and General Intelligence.
