من خلال هذه الدراسة سنسلط الضوء على الاحتلال باعتباره نزاع مسلح دولي، وذلك بموجب البروتوكول الإضافي الأول لعام 1977 الملحق باتفاقيات جنيف الأربعة لعام 1944.
كذلك سنحاول التركيز على مفهوم المبدأ الذي يخضع له الاحتلال والقائل: " بأن الحكومة الشرعية لها السيادة وليست لها السيطرة الفعلية، في حين المحتل له السيطرة الفعلية وليس له السيادة".
Abstract EN
From this study we will hav the lights on the occupation, because it is an international armed conflict according to the 1977 protocol.
Furthermone, we will try to focus on the principal on which the occupation obeys saying that : the legitimate government has the sovereignty, and not the actual power, while the occupier has the actual power but not the sovereignty.
