The urgent administrative case for the preservation of fundamental freedoms is the most important application of the administrative law, which is created by the Civil and Administrative Procedures Law, in order to consolidate the rule of law.
An emergency administrative judge may take all necessary measures to preserve fundamental freedoms, which are violated by the public moral persons or bodies that are subject to prosecution by the administrative judicial authorities while exercising their powers.
Provided that such action shall be adjudicated within 48 hours from the date of registration of the application.

Le référé administratif tendant à la préservation des libertés fondamentales est l’une des actions les plus importantes en matière administrative.
Une telle action, consacrée par le code de procédure civile et administrative algérien, est une garantie de protection des droits des citoyens contre l’arbitraire de l’autorité publique.
Le juge des référés peut ordonner toutes mesures nécessaires à la sauvegarde des libertés fondamentales, auxquelles des personnes morales de droit public ou des organismes dont le contentieux relève des juridictions administratives, auraient porté atteinte, dans l’exercice de leurs pouvoirs.
Dans ce cas, le juge des référés se prononce dans un délai de quarante-huit (48) heures à compter de sa saisine.
