Si la cessation de paiement des sociétés mène, en droit algérien, directement à l'application d'une procédure de règlement collectif ou de faillite; le droit comparé innove et modifie le concept de cessation de paiement et développe sa fonction.
La législation comparée offre plusieurs possibilités à la société de cesser de payer ses dettes, qu’il s’agisse de mécanismes judiciaires ou amicaux en vue de surpasser les risques de faillite.
