Bribery in public transactions is one of the most serious criminal offence because it undermines and disrupts development programs and may destroy the state’s treasury.

It includes the illegal gain that a public official earns while using his public position .this may lead to a widespread of corruption because of the seriousness of such phenomenon , the Algerian legislator has adopted the 06/01act on preventing and combating corruption under Article 27 of this act, bribery in public transactions is punishable by effective and severe penalties compared to other offences of corruption .thus this study we will address the legal framework of this crime and the legal mechanisms set by the legislator to deter, prevent and combat bribery
