Abstract EN

This paper aims to show the need of Islamic scholars (Mujtahid) to practice legal acumen and scholarship (ijtihad), taking into account the best interests of people.

This approach in making legal judgments is an old methodology practiced in the Prophet's life time, the companions' era, Tabiun, major legal schools of thought, majority of Muslim scholars and most Islamic jurists.

This principle is also considered as one of the significant basis in Islamic legislation which can be referred to when issuing new rules/laws related to recent situations and events.
