English Abstract

The study aimed to study the concept of dependency, the elements of dependence, the effects of availability and how to prove it, the importance of the element of dependence and its role in regulating the relationship between the worker and the employer, the legal adaptation of the dependency relationship in Jordanian law and comparative law, and the rights and obligations arising from the subordinate relationship between the worker and the employer.

This study is descriptive, and the results of the study showed that the dependency relationship is clear in the Jordanian civil law and the Jordanian labor law.

It is based on the actual authority of the employer on the worker.

The legal texts showed the nature of the relationship between the worker Work, and that the Jordanian legislator has integration between the responsibility of the employer and the responsibility of the world, as there are integrated in the dependency relationship between the employer and the worker, so as to judge the general restricted for General rule that no one asks for others to do.

The results indicate that the Jordanian legislator has been in the process of limiting the scope of the Labor Law, the method of exclusion, and has not followed the method of selection and enumeration of the categories to which the provisions apply.

There are three categories that do not apply to them: public servants, local bodies, domestic servants and the like, the study indicated that the relationship between the worker and the employer is the responsibility of the employer in the face of others.

The worker is exempted from such liability as long as the liability is due to an error committed in the performance of his work or because of it.

Approved by the general rules in where the plaintiff bears the burden of proving the relationship of dependency, which is often in a relationship and is the agent.
