تعتبر الصفقات العمومية أداة فعالة في التسيير و الاستعمال الأمثل للأموال العمومية، و قد حصر المشرع الجزائري طرق إبرامها في فرضيتين: المناقصة كأصل عام، و التراضي كاستثناء.
و أن هذه الطريقة الأخيرة، بالرغم من تحديد حالاتها، إلا أنه قد يكون وسيلة لمنح السلطة التقديرية للإدارة لإبرام الصفقات دون إتباع مختلف الإجراءات و الشروع مباشرة في اختيار المتعامل الذي تتوفر فيه إحدى الحالات المنصوص عليها قانونا، هذا ما قد يؤدي إلى تحايل الإدارة و إبرامها صفقات مشبوهة.
أما بالنسبة لإجراءات إبرام الصفقات العمومية، فقد عمد المشرع لتبيان أحكامها بنوع من التفصيل، إلا أنه أثبت عدم فعاليتها في الواقع العملي و عدم كفايتها لما يلاحظ من تجاوزات أثناء إبرامها بسبب عدم تطبيق النصوص القانونية ؛ و كذا استغلال الفراغات الموجودة في هذه النصوص لإبرام الصفقات غير المشروعة.
و ما يبرر أيضا عدم نجاعة التعديلات المتكررة لقانون الصفقات العمومية، هو محاولة المشرع و بصفة مستمرة في وضع نصوص فعالة للقضاء على التجاوزات.
Abstract EN
Public transactions is an effective tool in the management and the perfect use of public funds.
The Algerian legislature has reduced the ways of their conclusion in two cases, in this case the tender and the compromise in exceptional cases.
The latter, although its cases are determined legally, might be a way giving the administration a discretion to make deals regardless as to apply different legal procedures in this regard.
This way will make it easier for him to directly choose the operator considered in one of the cases provided by law.
However, this can lead to the subterfuge of the administration from the uncertain markets.
When it comes to procedures to be observed in the public procurement, the legislature knowingly determined in detail its provisions.
But they proved ineffective in practice given the excess arising during their procurement, which are due because, on the one hand, of the non-application of the legal texts, and on the other hand, exploitation of the gaps that include such texts.
What justifies also the ineffectiveness of the amendments repeated the Act of procurement, continually seeking the adoption of effective texts in order to eliminate some of the abuses.

Les marchés publics sont un outil efficace dans la gestion et l’utilisation parfaite des fonds publics.
Le législateur algérien a réduit les voies de leur conclusion dans deux hypothèses, en l’occurrence l’appel d’offres et le compromis dans des cas exceptionnels.
Ce dernier, bien que ses cas soient bien déterminés légalement, pourrait être un moyen octroyant à l’administration un pouvoir discrétionnaire de passer des marchés sans pour autant se soucier d’appliquer les différentes procédures légalement prévues à cet égard.
Ce moyen va lui faciliter la tâche de choisir directement l’opérateur envisagé dans l’un des cas prévus par la loi.
Or, cela peut conduire au subterfuge de l’administration en passant des marchés équivoques.
Pour ce qui est des procédures à observer dans la passation des marchés publics, le législateur a sciemment déterminé en détail ses dispositions.
Mais, elles sont avérées inefficaces dans la pratique compte tenu des excès surgissant lors de leur passation, lesquels sont dus en raison, d’une part, de l’inapplication des textes légaux, et d’autre part, de l’exploitation des lacunes que comportent lesdits textes.
Ce qui justifie également l’inefficacité des amendements répétés de la loi des marchés publics, le fait de chercher continuellement l’adoption de textes effectifs afin d’éliminer certains abus.
