Law No.

15-12 on the protection of the child was adopted to strengthen the protection of the child and, pending the promulgation of the executive decrees implementing its provisions, it instituted provisions for the protection of the child.

That law contains 150 articles divided into five parts, the first of which deals with general provisions concerning the determination of child protection rules and mechanisms at all levels, which led to the creation of a national body for the protection and protection of children.

La loi n° 15-12 sur la protection de l’enfant a été adoptée pour renforcer la protection de l’enfant et, dans l’attente de la promulgation des décrets exécutifs portant application de ses dispositions, elle a institué des dispositions relatives à la justice pour mineurs de manière systématique, voire méthodologique, en éliminant les erreurs et les incohérences qui résultaient des anciens textes tout en préservant les principes.

Cette loi renferme 150 articles répartis en cinq parties dont la première traite de dispositions générales concernant la détermination de règles et de mécanismes de protection de l'enfance à tous les niveaux, ce qui a conduit à la création d'un organe national de protection et de promotion de l'enfance, présidé par un commissaire national et ce, à côté de la protection judiciaire confiée au juge des mineurs.

En outre, la nouvelle loi, contrairement à ce qu’elle la précédait, prévoie les dispositions de la médiation, ce qui est considéré comme une véritable révolution dans la justice pour mineurs.

Or, le traitement de la protection de l’enfance par cette loi demeure incomplet, car elle n’a pas traité le sujet de manière exhaustive et, à tous les enfants victimes d’une infraction, elle s’est contentée de fixer l’écoute de l’enfant en cas seulement d’agression sexuelle.
