The principle of transparency is one of the fundamental principles registered in the Presidential Decree No.

15-247, for a better use of public funds.

Temporary subsidies could be one of the mechanisms used to achieve this transparency, by selecting the most capable operator (financially and technically).

This can be done through the diffusion of the temporary subsidies of the contract to inform the other operators and enable them, if necessary, to dispute these subsidies before the competent authorities (administrative and judicial), especially due to the breach of obligations in advertising and competitive bidding, to which public procurement contracts are subject.

Le principe de transparence est l'un des principes fondamentaux inscrits dans le décret présidentiel n°15-247, pour une meilleure utilisation des fonds publics.

Les subventions temporaires pourraient constituer parmi les mécanismes pour atteindre cette transparence, par la sélection de l'opérateur le plus fiable (financièrement et techniquement) et ce, à travers la diffusion des subventions temporaires du contrat afin d’informer les autres opérateurs.

Cette procédure permet, le cas échéant, à ces derniers de contester ces subventions auprès des autorités compétentes aussi bien administratives que judiciaires, notamment en raison de la violation des obligations de publicité et de mise en concurrence, auxquelles sont soumises les procédures de passation des marchés publics.
