The traditional theory of the law of war was essentially based on the distinction between international wars and non-international armed conflicts.

This distinction would have guided the principles of international humanitarian law to those armed conflicts which resulted in their parties in particular, Self-determination later.

In contrast, non-international armed conflicts were only applied to the minimum requirements of humanity.

If this distinction has its theoretical basis under traditional international law, the decline in the declaration of war on the one hand and the emergence of new people in the contemporary international community on the other hand would have made this distinction arbitrarily "found only in the will of the States themselves.
