The purpose of this article is to highlight in general the general liability of the doctor and concerns the study of contractual liability in view of its importance; since the general rule is that the medical liability is contractual and if found between the detrimental and the victim a valid contract; and the damage caused by the breach of contractual obligation on the part of the contracting parties.

Exceptionnally, the responsability of the doctor will be tortuous in case of absence of the contract.
