The Algerian legislator, by virtue of Order 15-02 of 23 July 2015, established a special route for the termination of the public proceedings, which was referred to as "mediation" as a preventive solution to resolve the dispute between the parties through the consensual agreement between them and under the supervision of the competent agent of the Republic.
Instead of pursuing the criminal follow-up that often ends in conviction, thus alleviating the burden of the judiciary facility on one hand and promoting the idea of restorative justice.
In order to ensure the implementation of the mediation agreement, the legislator ordered the complainant to refrain from implementing another offense called a misdemeanor to refrain from implementing the mediation agreement, which means that mediation is a civil agreement with criminal consequences
