Promotion to senior positions can take two forms: the first is the promotion in rank, and the second is the promotion in position.

Nevertheless, this type of promotion may prove impossible, in some instances, due to some impediment that prevents the employee from being promoted, despite fulfilling the required terms.

These impediments are dictated by explicit legal texts only.

Therefore, they are under the principle of legality, and administration cannot add other impediments, that are not mentioned in the successive legislation related to Civil service
