The administrative justice has taken a posture against the contractsconcluded in contrary of the articles of the law 62-03 of October23th 1962 conserning the deposit of vacant property, itavoidthiscontractsconcludedagainstthislaw, and thatisconfirmd by a numerous jurisprudence of the administrative tribunal or actualy state council.
The state’scouncil dont agree on this position concerningthiskind of contract by the judgement n°63457 of july 30th 2012wichitconcider the non-acceptance of the demande of avoideness , of thiscontracts by the abrogation of this last , and thispropertybecame a right for it’sowners, even if itspublished in differentservvices in financalministry.
