Abstract EN

In the Islamic legislation the health of man and its preservation is regarded as one of the most eminent basis on which the fundamental of health safety is standing on, from that the right of curing and request for curies guaranteed in this legislation for all individuals of the society; Where by some curies were forbidden for being dirty and unlawful or were mixed with lawful and clean ones.

And due to the huge scientific progress and the usage of these banned and dirties either extracted alone or mixed with others in the field of Medicine and the production of medicines or drugs.

So the scholars and the researchers attended to study this issue for arriving to its jurisprudential rule by a collective reasoning built on legitimate norms and on a medical scientific competence trusted with the spirit or soul of the Islamic legislation, its fundamentals and general regulations and its soft assets that became available for all times and spaces; this was showed in different approved legitimate rules among them: necessities permitted the forbids, and that the need is ranked in the position of the necessity if it is determined, and that if the matter is narrow it will be widened.
