Childhood is the most sensitive stage in human life, as the base and the background thatwilllay the foundations of the rest of his life, which is the foundation of the child'smind and soul.

Given the importance of thiscategory to all societies, as the ammunition of the future and the men of tomorrow, all countries are keen to provide all forms of protection for them, includingour Algerian legislator.

However, despitethis protection, todaywe are witnessing - and in our Algerian society in particular - the phenomenon of erosion of the foundations of the latter, and is increasingday by dayspread and ugliness, the phenomenon of kidnapping, rape and killing of children.

This phenomenon, whichincluded the mostheinousforms of crimes committedagainst the child, throughwhich the criminalsexposed all the forms of protection prescribed in this regard.

And the problemwewilladdress in this intervention - and thatdespite the application of penalties for the perpetrators of these crimes - is the reason for the inability of the legaltexts and penalties applied in the elimination of thisphenomenon and the realization of the basic function of the penalty, which is the generaldetenence? It is necessary, in light of tliisdeficit.
