Arabic Abstract

تناولت هذه الدراسة موضوع الاختصاص القضائي الدولي في المسائل المستعجلة حيث أن تطور الحياة الاجتماعية و الاقتصادية في العصر الحديث قد ادى إلى نشوء حاجات جديدة لكل مجتمع ، و قد استتبع ذلك قيام المعاملات بين افراد الدول المختلفة و ترتب على ذلك نشوء نوع جديد من الروابط القانونية و هي الروابط ذات الطابع الدولي أو المشتملة على عنصر اجنبي لذلك اصبح من الضروري البحث عن القواعد الملائمة لحكم هذه العلاقات و من ضمنها المسائل المستعجلة، حيث اصبحت القرارات القضائية المستعجلة امر واقع فرض نفسه على جميع التشريعات المعاصرة في شتى بقاع العالم لكي تلبي الايقاع المتسارع للحياة في كافة جوانبها، و التي تكون بحاجة إلى قرار مستعجل مشمول بالنفاذ المعجل، و يحوز الحجية المؤقتة و الذي يحد من المخاطر التي يتعرض لها الحق، و الذي يصعب الوصول اليه عن طريق قضاء الموضوع، لما يتصف به الاخير من اجراءات بطيئة و معقدة، و الذي قد يعجز عن حماية الحق لحين صدور حكم فاصل في موضوع الدعوى.

English Abstract

This study deals with International jurisdiction in matters of urgency since the development of social and economic life in the modern times have given rise to new needs for each society, this entailed the establishment of transactions between different countries individuals, and as a result the emergence of a new type of legal ties, which are links of an international nature or that include a foreign part.

Therefore, it became necessary to search for the proper rules to govern these relations, including urgent matters, where urgent judicial decisions became a de facto that imposed itself on all contemporary legislation in various parts of the world to meet the accelerating rhythm of life in all its aspects, which need an urgent decision that includes expedited access, and possesses temporary authority that limits the risks to which the right is exposed, which is difficult to reach by Subject matter court, due to the slow and complicated procedures of the latter, which might be incapable of protecting the right until a final ruling is issued on the merits of the case.
