Arabic Abstract

تناولت هذه الدراسة خيار الرؤية في العقد الإلكتروني، و الذي يعد صورة من صور الحماية التي منحتها التشريعات و القوانين لحماية المشتري، و يعود السبب الرئيسي لاختيار هذا العنوان هو أهمية سلامة الرضا في العقد الإلكتروني.

ففي الأوان الأخيرة بدأت التجارة الإلكترونية بالتوسع بشكل كبير في أغلب دول العالم حيث باتت أغلب العقود تبرم عن طريق الوسائل الإلكترونية فظهر ما يسمى : بالعقد الإلكتروني و الذي يتميز بعدة خصائص من أهمها توفير كل من الجهد و الوقت و النفقات و تخطي الحاجز المكاني، و على الرغم من تلك الميزات إلا أن النزاعات و الخلافات حوله ما زالت في تزايد مستمر و يعود ذلك لعدة أسباب كان من ضمنها الخلل و النقص الذي يصيب سلامة رضا المتصرف له ( المشتري ).

و بالرجوع إلى القوانين المتعلقة بالعقود التي تبرم عن طريق الوسائل الإلكترونية مثل قانون المعاملات الإلكتروني الأردني رقم 15 لسنة 2015 لم نجد نصوصا خاصة تتعلق بسلامة الرضا لدى أطراف العقد و عليه كان لا بد من الرجوع إلى القانون المدني الأردني للبحث عن نصوص قانونية تعنى بالحد من الخلل أو النقص في الرضا في العقد الإلكتروني و من خلال البحث وجدنا ما يسمى بخيار الرؤية و الذي حدد فيه المشرع الأردني الشروط الواجب توافرها لثبوت الخيار و مدته و الحالات التي يسقط فيها .

و جاءت هذه الدراسة لتسليط الضوء على كيفية تطبيق خيار الرؤية كحق يضمن سلامة الرضا من أي خلل أو نقص في العقد الإلكتروني و الذي يعد من العقود حديثة النشأة، حيث اعتمدت الدراسة على المنهج التحليلي و المقارن لدراسة ضوابط خيار الرؤية و العقد الإلكتروني في كل من القانون المدني و قانون المعاملات الإلكتروني الأردني و الذي قدمت من خلالها مجموعة من النتائج و التوصيات كان من أهمها عدم كافية النصوص القانونية التي يمكن من خلالها معرفة الضوابط التي تحكم خيار الرؤية و كيفية تطبيقها في العقد الإلكتروني.

English Abstract

This study addressed the option of visual verification in the e-contract, which considers a form of protection granted by legislation and laws to protect the purchaser, the main reason for selecting this topic for debating is the importance of the integrity of satisfaction in the e-contract, recently, the e-commerce began to expand significantly worldwide, as most contracts have been concluded electronically, accordingly, what called electronic contract has emerged, which is characterized by several advantages, in which the most important of it, is saving efforts, time, expenses and overcome the spatial barrier, despite these advantages, however, disputes and strife about it increasing, due to several reasons, including the defect and deficiency that affects the integrity of satisfaction of the customer (the buyer).

By searching within the legal provisions that related to contracts which concluded electronically, such the Jordanian Electronic Transaction Law No.

(15) of (2015), there were no special provisions dealt with the integrity of satisfaction of the contract parties, therefore it was necessary to refer to the Jordanian Civil Law to search for legal provisions that address the reduction of defects or deficiencies of the satisfaction within the econtract, and through the research, the so-called visual verification option was observed, in which the Jordanian legislator defines the conditions that must be met to validly the option, duration, and the cases in which the option spoilage.

Accordingly, this study highlighted how to apply the option of vision as a right secure the integrity of satisfaction against any defect or deficiency within the electronic contract, which is newly emerged, as this study relied on the analytical and comparative approach to study the regulations in which govern both the option of the visual verification and the e-contract in the Jordanian Civil Law and the Jordanian Electronic Transaction Law, as this study submitted a set of results and recommendations, in which most important is the insufficient legal provisions through which identifying the controls of applying the vision option and how to implement the option of visual verification within the e-contract.
