Arabic Abstract
تناولت الدراسة موضوع أحكام عدم الانتفاع بالمأجور لسبب يتعلق بالسلطات المختصة، من خلال نص المادة ( 698 ) من القانون المدني الأردني و توصلت الدراسة أن هناك نوعين من التعرض الصادر من السلطات المختصة تعرض قانوني و تعرض مادي، و يتسبب التعرض الصادر من السلطات المختصة إلى عدم انتفاع المستأجر بالمأجور كلبا أو جزئيا.
و انتهت الدراسة بمجموعة من النتائج و كان أهمها : في حالة عدم الانتفاع الكلي بالمأجور يسبب التعرض الصادر من السلطات المختصة تتفسح الأجارة و تسقط الأجرة من وقت الملع، أما إذا كان المنع جزئيا يحق للمستأجر فسخ العقد و تسقط الإجرة من وقت إعلام المؤجر بالتعرض.
كما توصلت الدراسة إلى عدة توصيات و كان من أهمها : النص على إلزام السلطات المختصة بتعويض المستأجر عن التعرض المادي الصادر منها في القانون المدني الأردني.
English Abstract
The study dealt with the provisions of non-use of wages for a reason relating to the competent authorities, by the text of article 698 of the Jordanian Civil Code, the study found that there were two types of exposure from the competent authorities that were legally and physically exposed, the exposure of the competent authorities causes the lessee to not make full or partial use of the wage.
The study reached several results, the most important of which are: If the total benefit of the wages is not due to exposure from the competent authorities, the renting shall be degenerated and the fee shall be dropped from the time of prevention.
If the prohibition is partially the lessee has the right to terminate the contract and the fee falls from the time the lessee is informed of the exposure.
The study also reached several recommendations, the most important of which were : Provide for the requirement of the competent authorities to compensate the lessee for the material exposure from which it was made in the Jordanian Civil Law.
