Arabic Abstract

يدور موضوع هذه الرسالة حول إجماعات ابن القطان رحمه الله في كتابه الإقناع في مسائل الإجماع من أول كتاب الصيد و الذبائح إلى أخر كتاب الأطعمة و الأشربة، دراسة فقهية مقارنة.

و نظراً لأهمية هذا الكتاب الجليل من جهة و لما يترتب على ثبوت انعقاد الإجماع من عدمه من جهة اخرى، و لما كان الكتاب مرجعاً في الفقه المقارن، فقد جاءت هذه الرسالة لتفرد مسائل الإجماع بالتدقيق و التحري فتقرر ثبوت الإجماع من عدم ثبوته وفق المنهج المرسوم لذلك .

و قد سبق ذلك كله ترجمة موجزة للإمام ابن القطان رحمه الله.

و دراسة للإجماع في الشريعة الإسلامية من تعريف الإجماع و بيان أهميته و حجته و شروطه و أنواعه .

English Abstract

The subject of this study revolves around Ibn al-Qattan's Cases of Consensus in his book " Kitab Al-Iqnaa' fi masaa'il Al-Ijmaa" from the beginning of the book of hunting and slaughter to the last book of food and beverages, a comparative Fiqh study.

In view of the importance of this great book on the one hand, and the consequence of proving that there was consensus or not on the other hand, and since the book was a reference in comparative Fiqh , this study came to singularize the cases of consensus with scrutiny and investigation, so it was decided to prove the consensus of its lack of proof according to the method described for that.

All of this was preceded by a brief translation of Imam Ibn AlQattan, may God have mercy on him.

A study of consensus in Islamic law, from defining consensus and explaining its importance, argument, conditions, and types.

The number of cases discussed in this thesis reached twenty seven cases, and consensus was achieved in sixteen cases, and consensus was not achieved in eleven cases.
