Abstract AR

يعد السكوت أمر سلبي غير مقترن بموقف أو مسلك، فهو يعني عدم القيام بأي فعل أو سلوك، و هو على نوعين، الأول و هو السكوت المجرد و المقصود منه السكوت الخالي من أي ظروف قد تدل على قبول أو رفض، و هذا النوع من السكوت لا يدل على شيء و لا يترتب عليه أي أثر قانوني ؛ أما النوع الثاني و هو السكوت الموصوف، و الذي يقصد به السكوت المقترن بظروف تدل على الإرادة، و يكون هذا السكوت معبرا عن الإرادة في القانون الدولي، و يرتب آثارا قانونية.

تطبق محكمة العدل الدولية مبدأ القبول، و قاعدة الإغلاق على الحالات الخاصة بالسكوت، يقصد بمبدأ القبول سكوت الدولة و عدم احتجاجها على ما تعتقد أنه انتهاك لحقوقها، و الذي يترتب عليه افتراض قبولها عما سكتت عنه، أما قاعدة الإغلاق، فيقصد بها منع الدولة من مخالفة سلوك سابق لها و إلزامها به، تحقيقا للاستقرار في العلاقات الدولية، فضلا عن محاولتها لإخضاع السكوت إلى تنظيم قانوني.

اتخذ فقهاء القانون الدولي اتجاهين مختلفين في تكييف السكوت، إذ يذهب الفقه الارادي الى اعتبار السكوت مظهرا من مظاهر التعبير عن الإرادة شرط أن يكون مقترنا بالعلم، أما الفقه الموضوعي فيذهب إلى أن السكوت يرتب آثارا قانونية على أساس المسؤولية المترتبة عن الخطأ.

Abstract EN

Silence is a negative thing that is not associated with a situation or behavior, it means not to do any act or behavior, and it is of two types, the first is the silence is abstract and meant silence free of any circumstances may indicate acceptance or rejection, and this type of silence does not indicate anything The second type is the silence described, which means silence associated with circumstances indicating the will, and this silence reflects the will in international law, and has legal effects The International Court of Justice applies the principle of acceptance and the rule of closure to cases of silence.

The principle of acceptance means the state's silence and non-protest of what it believes is a violation of its rights, which entails assuming its acceptance of its silence.

It is obliged to achieve stability in international relations, as well as its attempt to legalize silence Jurisprudence in international law has taken two different directions in adapting silence: voluntary jurisprudence considers silence to be a manifestation of the expression of will, provided that it is combined with science, and objective jurisprudence holds that silence has legal implications based on the responsibility for wrongdoing.
