The problematic of children unknown filiation had arisen in thorny way since primitive societies of Islam.

But over time, thevmuslim jurists, have been able to find pratical and real solutions for this phenomenon, inspired bye the venerable islamic law, which garantees the respect and the dignity of each individual.

The constant concern on the part of these juristconsult has, in fact, given on abondance of codes and rules, forming a real psycho-social protection, espcially with regard to the private child (or of unkown origin " bastard " ), In most Arabe countries, including Algeria, there is unfortumately a terrible lack of legislation concerning this category of disadvantaged children, The return therefore to the islamic jurisprudence is vigoroosly imposed in the treatment of certain cases like the managment -- guardianship or right of custody -- host families, , , , and from where, we can also take advantage to solve a lot of psychological, social and even criminal issues that we know today.
