حسب نص المادة 16من النظام الأساسي للمحكمة الجنائية الدولية فأن مجلس الأمن يستطيع منع إجراء التحقيق أمام المحكمة أو توقيف الاستمرار فيه و ذلك لمدة سنة كاملة يمكن أن تجدد لأجل غير مسمى لكن هذه السلطة ليست مطلقة ذلك لأن تجديد المدة قد يكون نظريا أكثر منه حقيقيا لأنه يحتاج إلى اتفاق جميع الأعضاء الدائمين في مجلس الأمن و مرهون الى الفصل السابع من ميثاق الأمم المتحدة.
Abstract EN
According to Article 16 of the Statute of the International Criminal Court, the Security Council can prevent or stop the investigation of the Court for one year renewable indefinitely, but this authority is not olute, for the renewal of the mandate can be more theoretical than real, because it requires the agreement of all the permanent members of the Security Council, it is governed by Chapter VII of UN Charter
