The application of foreign law is excluded in two cases, the first case if it is contrary to public order or public morals in Algeria and the second case if it is proven to him jurisdiction by fraud towards the law, and this is according to Article 24 of the Algerian Civil Code first paragraph, and we have examined in this study the second case which is Fraud towards law.

This payment was not stipulated by the Algerian legislator until after the promulgation of Law 10-10 of June 20, 2005 amending and supplementing the Civil Code.

The Algerian legislator has done a good job according to what is explicitly stipulated in this payment contrary to many legislations that did not address the issue despite its importance
