إشكالية إخضاع المقاول من الباطن للمسؤولية العشرية في القانون الجزائري

Abstract EN

This paper seeks to address how the subcontractor becomes subjected to the decennial liability as it is a strict liability that makes the contractor and the architect responsible for the potential collapse of the building for a period of ten years.

Afterward, the concept was expanded to include another actor, namely the subcontractor who was not concerned by this legislative before, because, firstly the subcontract makes the original contractor responsible for his work towards the employer and secondly due to the absence of the contractual relationship, in addition, the main objective is to protect the employer as he ignores the art of construction and manufacturing, also protecting the public interest.

Indeed, this study aims to clarify the different measures took by the Algerian legislator after he has engaged the subcontractor in decennial liability regarding real estate development, for the purpose to protect the principal contractor and preserving the public interest.

Cet article traite la problématique de la soumission de sous-traitant a La responsabilité décennale comme responsabilité exceptionnelle imposée dix ans à l’architecte et l’entrepreneur ,pour tester tout défaut pouvant menacer la sécurité et la durabilité de la construction, après d’autres parties sont inclues à cette responsabilité par des textes spécifiques, parmi eux le sous-traitant qui n’était pas impliqué selon un texte explicite, car les dispositions de la sous-traitance font de l’entrepreneur principal responsable de ses actions envers le maitre de l’ouvrage, et en raison de l’absence d’un lien contractuel avec ce dernier, de plus cette responsabilité était initialement décidée pour protéger le maitre d’ouvrage vu son ignorance technique de la construction ainsi que l’intérêt public, sans protéger l’entrepreneur principal.

Le législateur algérien implique le sous-traitant dans cette responsabilité pour la promotion immobilière, a fin d’intensifier la protection de l’intérêt public tout en assurant celle de l’entrepreneur principal contre ses fraudes.
