يشكل الاختصاص الموضوعي للمحكمة الجنائية الدولية أهم إشكال لها و الذي لا يغطي في الوقت الحالي سوى الجرائم الدولية الكلاسيكية جرائم الحرب و الجرائم ضد الإنسانية و الإبادة الجماعية.
إذ لا يتضمن النظام الأساسي للمحكمة الجنائية الدولية أي أحكام تتعلق بالأعمال الإرهابية و كل المحاولات للقيام بذلك خلال المفاوضات في ندوة روما باءت بالفشل.
و بشكل عام شكل تحديد الجرائم التي تدخل ضمن اختصاص المحكمة الجنائية الدولية عند صياغة نظام روما الأساسي مسألة شائكة.
و قد أعرب معارضوا إدراج جرائم الإرهاب الدولي في اختصاص المحكمة عن تحفظات قانونية و سياسية..
Abstract EN
The problem with the ICC is the problem of its matrial jurisdiction, which at present covers only classic international crimes, war crimes, crimes against humanity and genocide.The ICC Statue does not contain any provision on terrorist acts, all attempts to do so during negociations at the failed rome conference.
In general, when drafting the Roma Statue, the definition of crimes falling within the jurisdiction of the ICC was a thomy issue.
Opponents of the inclusion of international terrorism in the court’s jurisdiction have expressed legal and political reservations.
