Arabic Abstract

جاءت هذه الدراسة بهدف الوقوف على واقع الرقابة الدستورية على القوانين في العراق و مقارنتها بالأردن و مصر، من خلال بيان دور الرقابة على دستورية القوانين و الأنظمة النافذة في العراق و التطور الذي حصل على هذه الرقابة، إضافة إلى بيان مدى فرض رقابة دستورية على القوانين و الأنظمة في العراق في ظل وجود هيئة قضائية مستقلة و هي المحكمة الاتحادية العليا، و قد توصلت الدراسة إلى مجموعة من النتائج و التوصيات، حيث تمثل أبرز النتائج وجود اختلاف و تناقض بين نصوص دستور العراق 2005 فيما يخص استقلال القضاء حيث تجد أن هناك مواد في الدستور منحت الاستقلال الكامل للقضاء ماليا كان أم إداريا إلا أنه في نصوص أخرى.

سمحت بتدخل الهيئتين التشريعية والتنفيذية.

أما أبرز التوصيات التي قدمتها الدراسة فتتمثل بضرورة النص صراحة في قانون المحكمة الاتحادية العليا او قانون المحكمة الدستورية في الأردن على التزام المشرع بإلغاء القانون أو النظام المقضي بعدم دستوريته خلال فترة زمنية معينة من تاريخ صدور الحكم بعدم الدستورية و ذلك لكي تتحقق الأحكام المحكمة الدستورية الحجية المطلقة في مواجهة السلطات العامة و الكافة.

English Abstract

This study came with the aim of identifying the reality of constitutional oversight of laws in Iraq and comparing it to the reality in Jordan and Egypt, by showing the type of oversight over the constitutionality of laws and regulations in force in Iraq and the development that obtained this oversight, in addition to explaining the extent to which constitutional oversight is imposed on laws and regulations in Iraq.

Iraq is in the presence of an independent judicial body, which is the Federal Supreme Court, and the researcher has used a number of scientific approaches.

The study reached a set of conclusions and recommendations, which represent the most prominent results.

We noticed a difference and contradiction between the texts of the 2005 Constitution of Iraq with regard to the independence of the judiciary, as we find that there are articles in the constitution that granted full independence to the judiciary, whether financial or administrative, but in other texts that allowed the intervention of the legislative and executive.

As for the most prominent recommendations presented by the study, they are represented in the necessity to explicitly stipulate in the Federal Supreme Court Law or the Constitutional Court Law in Jordan that the legislator shall abolish the law or system ruling that it is unconstitutional within a certain period of time from the date of the ruling on unconstitutionality, in order for the Constitutional Court to achieve absolute and authentic rulings.
