The issue of administrative pre-emption as a mechanism to acquire the real estate is of legal, economic and political importance, Therefore, the provisions regulating this mechanism under special texts based on the privacy that distinguishes it from civil preemption under the provisions of the Algerian Civil Code, To open the field of the property with good exploitation of the real estate and it's protection from illicit speculation, division and fragmentation, One of the main recommendations of this research work is that the legislator should reconsider procedures that strictly define its practice, such as civil pre-emption, to remove any ambiguity that might hinder this mechanism.
