إن قضية تجديد الفقه ينبغي أن تضع ضمن أولوياتها إحياء حركة علمية تعنى بدراسة النوازل و القضايا البشرية الجديدة دراسة معمقة في استقلالية تامة و اعتمادا على الحجة و الدليل حتى يكون الفقه الإسلامي مواكبا لكل تطورات العصر حاضرا في كل القضايا مستجيبا لكل التطلعات و هو ما استطاع الإمام القنوجي أن يحققه من خلال ترجيحاته الفقهية في كتابه (فتح البيان).
Abstract EN
The issue of renewing jurisprudence should include among its priorities the revival of ascientific movement that is concerned with the study of cataclysms and new human issues in depth study in complete independence and depending on the argument and evidence so that the jurisprudence is in keeping with all developments of the age to solve all problems despite its complexities which is whatAl Qanuji could achieve through its jurisprudential weightings.
